In case anyone else was wondering, I got around the problem using the
second method.  I now have something like:

someMod[f_List, opts___?OptionQ]:=
  Module[{..., opts1},
     opts1=Select[{opts}, !MemberQ[#,PlotLegend]&;
     MultipleListPlot[f, Sequence@@opts1];
     (some other commands)];
