These functions are implemented to use call by reference. All the remaining Mathematica functions (excluding Set ofcourse) are using a call by value.
There is a work around, but it does not worth the effort. It is better (or in other terms, more efficient) to get used to the way Mathematica work then trying to adopt concept of other programming languages
